In the US, former Finance Minister Ken Ofori-Atta has made a significant legal advancement. His request for permanent residency was granted by an American immigration court on Monday.
The court carefully examined his status while taking into account the numerous
criminal allegations he presently faces back home in Ghana, and this decision
represents a major turning point in his ongoing legal path.
The judge reviewed the activities of Ghana's Office of the Special Prosecutor (OSP) during the hearing, particularly with regard to the declaration designating Mr. Ofori-Atta as a fugitive.
Evidence presented to the court suggested that this designation was affixed while the former minister was still in contact with Ghanaian investigators and undergoing medical treatment overseas.
An expert witness also questioned Ghanaian authorities' handling of international police protocols, such as the now-deleted INTERPOL Red Notice.
Although the criminal cases against him in Ghana are not dismissed by this US court order, legal experts feel that this development could make it more difficult to get him back to stand trial in the future.
The Ghanaian courts continue to have jurisdiction over the grave financial accusations associated with his tenure as finance minister, notably the Strategic Mobilization Limited contract.
For the time
being, this residency approval provides a new dimension to a well-known case
that is still garnering public interest.
